In summer 2023, the plaintiffs were traveling to their vacation home when the defendant’s SUV crossed into the opposing lane of travel and struck their vehicle head-on.

Both plaintiffs were extricated from their vehicle and transported by ambulance to separate hospitals for emergency treatment.

The 75-year-old husband sustained significant chest and spinal trauma, cardiac complications requiring additional hospitalization and invasive treatment, and post-concussive symptoms.

He underwent extensive rehabilitation, multiple surgeries, and continues to experience functional limitations.

The 74-year-old wife sustained multiple fractures and soft tissue injuries. She was hospitalized and required several months of in-home nursing and rehabilitative care.

Her injuries resulted in prolonged mobility restrictions and ongoing limitations in daily activities.

The defendant later pleaded guilty to negligent operation and related motor vehicle offenses.

Suit was filed and the matter proceeded through discovery and expert development. The defense disputed causation, permanency, and the scope of future medical care, and also challenged the extent of the plaintiffs’ claimed functional limitations.

Following extensive litigation and trial preparation, including retention of medical experts and preparation for jury presentation, the cases resolved at mediation for a combined $3 million.
