Prince Lobel Tye partner Kenneth A. Sherman’s ability to navigate the complexities of construction law, whether in high-value contract negotiations or intricate litigation, makes him a trusted advisor to developers, contractors, suppliers and public agencies. His broad industry knowledge and strategic approach have positioned Sherman as a leader in construction law, capable of delivering results in both transactional and dispute resolution matters.
Sherman’s ability to craft tailored legal solutions is evident in his development of a bespoke suite of construction forms for an owner constructing multi-state recreational and medical cannabis retail facilities. Sherman has also played a crucial role in national real estate development, assisting real estate developers and a national veterinary clinic chain with construction and design agreements for commercial and residential projects across multiple states. His work with material suppliers has further solidified his reputation, having advised clients on purchase orders, supply agreements and lien waivers for public and private construction projects throughout New England and New York.
Meanwhile, Sherman has spent more than a decade litigating complex construction disputes, advocating for general contractors, subcontractors and design professionals in securing payments, defending performance and resolving claims related to mechanic’s liens, retainage, contractor terminations and surety bond recoveries.
Sherman’s dispute resolution expertise includes representing clients in high-stakes litigation, such as wrongful termination claims and public transit agency cases involving delay and non-payment issues. He has handled cases involving more than $50 million in high-end residential construction disputes, and recently represented a national homebuilding company in condominium construction defect litigation.
